Point Program Terms
Article 1 (Purpose)
1. These Terms and Conditions set forth the terms and conditions under which Small Planet Co., Ltd. (hereinafter referred to as “the Company”) provides the Point Service (hereinafter referred to as “the Service”) to members who have registered as members in accordance with the Point System Rules (hereinafter referred to as “the Rules”).
2. Matters not specified in these Terms and Conditions regarding the Service shall be governed by the Rules.
Article 2 (Awarding of Points)
1. The Company shall award “points” (hereinafter referred to as “Points”) to Members when they purchase goods or use services at the HERE!! [Official] Online Store (hereinafter referred to as “the Store”) using the method specified by the Company, or in other cases deemed appropriate by the Company.
2. The services and transactions eligible for point accrual (hereinafter referred to as “Eligible Transactions”), the point accrual rate, and other conditions for point accrual shall be determined by the Company and notified to members on the relevant page of the designated website.
3. Points will be credited 14 days after the completion of shipment of the product following an Eligible Transaction. If we confirm that an Eligible Transaction has been canceled or returned, no Points will be awarded for that transaction; furthermore, if the price of an Eligible Transaction is changed, Points will be awarded based on the revised purchase amount.
4. The final determination regarding whether to award Points for a transaction, the number of Points to be awarded, and other matters related to the awarding of Points shall be made by us.
Article 3 (Management of Points)
1. The Company shall notify members of the number of points earned, the number of points used, and the remaining point balance in accordance with the methods prescribed by the Company.
2. If a member has any doubts regarding the point balance described in the preceding paragraph, the member shall immediately contact the Company and explain the details.
3. The Company shall make the final determination regarding the point totals specified in Paragraph 1.
Article 4 (Prohibition on Combining Points and Multiple Registrations)
1. Members may not transfer or pledge their points to other members, nor may they share or combine points with other members.
2. If a single member has multiple member registrations, the member may not combine the points held under each registration.
Article 5 (Cancellation and Expiration of Points)
1. If, after the Company has awarded points, there is a return, cancellation, or other reason regarding the applicable transaction that the Company deems appropriate to revoke the award of points , the Company may revoke the points awarded for the applicable transaction.
2. If the Company determines that a Member falls under any of the following items, the Company may revoke some or all of the points held by the Member without prior notice to the Member.
(1) In the event of illegal or fraudulent conduct
(2) In the event of a violation of these Terms and Conditions, the Membership Rules, or other regulations and rules established by the Company
(3) In any other case where the Company deems it appropriate to revoke points awarded to a Member
3. Points will automatically expire upon exceeding the validity period specified by the Company (one year from the date of award; for additional points earned during a “Points Boost” period, 90 days from the date of award).
4. The Company will not provide any compensation for revoked or expired points and assumes no liability whatsoever in this regard.
Article 6 (Incidents, etc.)
If any incident—such as delay, loss, theft, damage, or breakage—occurs during the delivery or after the provision of goods or services obtained through the use of points, the Company shall bear no liability whatsoever, except where such incident is attributable to the Company’s responsibility, and may not be able to refund the points.
Article 7 (Cancellation of Points After Use)
If points are canceled pursuant to Article 5, Paragraph 1 or 2 after they have been used, the transaction subject to the relevant payment (hereinafter referred to as the “Points-Used Transaction”) may be canceled or placed on hold. If a Point Redemption Transaction has already been executed or is about to be executed, the Member shall immediately pay the resulting shortfall resulting from the cancellation of points to the Company in cash or via a payment method designated by the Company.
Article 8 (Prohibition on Cash Redemption)
Under no circumstances may a Member redeem points for cash.
Article 9 (Use by Third Parties)
1. Points may only be used by the Member personally and may not be used by any third party other than the Member.
2. The Company shall deem the use of points under a specific Member number to be the use by the person holding that Member number. Even if such use constitutes unauthorized use by a third party, the Company will not refund the points used and shall not be liable in any way for any damages incurred by the Member.
Article 10 (Loss or Suspension of Membership Status)
If a member loses their membership status, they shall forfeit all points held, the right to exchange them for benefits, and all other rights related to the use of this Service; furthermore, they shall not acquire any claims against the Company as a result of the loss of membership status.
Article 11 (Disclaimer)
The Company will use its best efforts to operate this Service based on the current state of technology, but does not guarantee that no disruptions will occur. The Company shall not be liable for any damages incurred by Members in connection with this Service, including system interruptions, delays, suspensions, or data loss caused by failures in communication lines or computers; issues related to the use of points; damages resulting from unauthorized access to data; or any other damages.
Article 12 (Changes to the Service)
1. The Company may, without prior notice to Members, amend these Terms of Service, the content of the Service, or the conditions for providing the Service (including, but not limited to, the abolition of points, suspension of point accrual, changes to eligible sites or transactions, and changes to point accrual rates or usage rates), and may terminate or suspend the Service. Members hereby agree to this in advance.
2. The Company shall not be liable in any way for any disadvantage or damage incurred by Members as a result of the changes described in the preceding paragraph.
